This action arises from the allegation that Defendants, United States Department of Labor (“USDOL”) and Hilda Solis (“Solis”), United States Secretary of Labor, through the Administrative Review Board1 (“ARB”) acted unlawfully under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq.
