MEMORANDUM AND ORDER

ROBERT JOHN HALL, Bankruptcy Judge.

The court has before it the motion of Gulf Oil Corporation (“Gulf”), seeking the appointment of a trustee under 11 U.S.C. § 1104(a) (“trustee motion”). This motion was instituted by Horizon Products Company (“Horizon”) on November 30, 1983. Gulf informally became a participant during the initial hearings on this matter. When Horizon and the debtor, General Oil Distributors, Inc. (“G.O.D.”), sought to settle the matter, Gulf vigorously objected.
