Appeal from the Circuit Court of Cook county; the Hon. John Gibbons, Judge, presiding. This was a bill in equity, brought by Melville Clark in the circuit court of Cook county, against John McGee, to enjoin the erection of a certain building and asking for the removal of the building. Upon filing the bill a temporary injunction was granted. The defendant appeared and put in an answer to the original bill and entered a motion to dissolve the injunction.

Dray, who owned a tract of land in Chicago consisting of five acres, laid it off into thirty-eight lots, nineteen on each side of that part of Rhodes avenue lying between Seventy-second and Seventy-third streets.
