Before the court is an appeal by the State of Montana, Montana Department of Environmental Quality (“DEQ”), and Spectrum Engineering, Inc. (“Spectrum”) (collectively, “Appellants”) from the bankruptcy court’s March 29, 2002 order (Bankr. File # 59) denying their motion to dismiss plaintiffs’ complaint.
