RICHARDSON, Judge.

The information in this case charged that plaintiff in error sold intoxicating liquor on April 5, 1909. The evidence for the prosecution was to the effect that the sale was made on that specific date, and there was no evidence tending to show a. sale at any other time. The state’s witnesses testified positively to' the date of the transaction, though they were not entirely certain that plaintiff in error was the person who made the sale.
