Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Director of the Office of Health Systems Management, New York State Department of Health, which recalculated petitioner’s Medicaid reimbursement rates. In May of 1966, petitioner, Nicholas Demisay, and one Dr. Panzer entered into a partnership agreement to operate a nursing home.
