Defendant, Robert Z. Tate, was charged by criminal complaint with possession of drug paraphernalia (720 ILCS 600/3.5(a) (West 2002)), unlawful consumption of liquor (235 ILCS 5/6 — 20 (West 2002)), and unlawful possession of less than 2.5 grams of cannabis (720 ILCS 550/4(a) (West 2002)). Defendant moved to suppress evidence obtained by the police as being unlawfully seized. The trial court granted the motion and denied the State’s motion to reconsider.
