This case comes before the Court on Defendant Michael J. Astrue, Commissioner of the Social Security Administration’s (“Defendant”) motion to dismiss or alternatively for summary judgment of Plaintiff Earl Tucker’s (“Plaintiff’) claims alleging employment discrimination and retaliation. Plaintiff has also filed a motion to amend his amended complaint to assert claims under the Tucker Act and the Little Tucker Act.
