MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Larry Norals (“Norals”) sues his former employer Schneider Brothers, Inc. (“Schneider”), alleging it fired him because of his race in violation of Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e et seq.) and 42 U.S.C. § 1981 (“Section 1981”). 1 Schneider now moves to dismiss Norals’ complaint under Fed.R.Civ.P. (“Rule”) 12(b)(6), relying on the allegedly preclusive effect of Norals’ earlier loss of unemployment insurance benefits before the Board of Review of the Illinois Department of Labor.
