ABMSTBONG, • Judge.

An information was filed against the plaintiff in error in the district court of Oklahoma county on the 5th day of April, 1909, after he had had a preliminary examination as provided by law, charging him with having murdered Mrs. Pearl Pearson of Oklahoma City on the 16th day of September, 1908. The case came on for trial on the 28th day of June, 1909, and a verdict of guilty was returned by the jury on July 17, 1909, fixing his punishment at imprisonment for life at hard labor in the state penitentiary.
