Kevin Dwight appeals from an order of the Court of Common Pleas of Philadelphia County granting the motion for summary judgment filed by the Commonwealth of Pennsylvania, Department of Corrections (Department), and dismissing with prejudice Dwight’s complaint against the Department. The issue raised for review is whether summary judgment was appropriate where it was based solely upon information deemed admitted after Dwight’s untimely response to the Department’s request for admissions.
