I. Appellee beld a mortgage on certain real estate belonging to tbe defendant North. Action was begun for tbe foreclosure of said mortgage, and, upon application of the mortgagee, an order was entered, on November 3, 1923, appointing a receiver for said premises, and ordering the said receiver "to collect all the rents, issues, income, and profits of said premises, and hold the same subject to the further order of this court.” The petition in said foreclosure proceeding was filed on November 3, 1923.
