RAMSEY, Judge.
The appeal in this case is prosecuted from a conviction for murder in the first degree, had in the District Court of Trinity County on February 16 of this year, in which judgment of conviction appellant’s punishment was assessed at confinement in the penitentiary for life.
The case is a very singular one, and it will be necessary to make a somewhat detailed statement of the fa'cts in order to make the opinion understood.
