PUTNAM, District Judge.
This condemnation suit was filed on July 9, 1964 by the United States at the request of the Secretary of the Army. Texaco, Inc. and The Texas Pipe Line Company were served with notice of this suit in accordance with the provisions of *798Rule 71A, Federal Rules of Civil Procedure. This rule provides, inter alia, that all persons having an interest in properties affected by a condemnation action instituted by the United States should be served with notice thereof.
