In this appeal the appellant, Sherman Bros. & Co., a corporation, seeks to reverse a judgment of the Circuit Court of Cook County rendered against it March 16, 1909, in favor of John F. Schleuter, the appellee, for $1,209.

John F. Schleuter sued Sherman Bros. & Company October 31,1905, in assumpsit, alleging in a declaration of several counts the breach of a promise alleged to have been made by the defendant corporation, that certain coffee sold by them to him should be of’ a certain grade.
