By indictment returned in the Circuit Court of St. Louis County, Frank Fiorino and the appellant herein, whom we shall call defendant, were charged jointly with the crime of grand larceny, alleged to have been committed in said county on August 17, 1934. It seems Fiorino absconded. Defendant Nicoletti was granted a severance, and after several continuances he was tried alone, was convicted and sentenced to two years' imprisonment in the penitentiary and has appealed.
