LOKEN, Chief Judge.
In this case that was briefed and argued before the Supreme Court’s decision in United States v. Booker , — U.S. -, 125 S.Ct. 738, 160 L.Ed.2d 621 (2005), David L. Robinson pleaded guilty to possession of a firearm by an unlawful user of a controlled substance in violation of 18 U.S.C. § 922(g)(3). At sentencing, Robinson moved for a downward departure on the ground that he has an “extraordinary physical impairment.” See U.S.S.G. § 5H1.4 (p.s.).
