Under an indictment charging the malicious murder of Levi Brown, by strangling him with the hands, appellant was convicted of murder without malice and his punishment assessed at three years' confinement in the State penitentiary.

Early Sunday morning, June 25th, 1939, the body of deceased was found in the northeast section of the City of Mt. Pleasant, in the vicinity of the railroad tracks, and near a blacksmith shop and a shirt factory. It was lying in grass about knee high.
