Adrian Green (hereinafter defendant) was charged in a single indictment with three counts of murder of Andrew Mitchell (Ill. Rev. Stat. 1971, ch. 38, pars. 9 — 1(a)(1), 9 — 1(a)(2), and 9 — 1(a)(3)) and one count of attempt armed robbery of Andrew Mitchell (Ill. Rev. Stat. 1971, ch. 38, pars. 8 — 4 and 18 — 2). A jury trial resulted in a verdict of not guilty on the murder charges and guilty on the attempt armed robbery charge.
