This was an action by Mattie Dandridge, tbe divorced wife of P. O. Dandridge, against tbe said P. C. Dandridge to declare a trust for certain real property. It was claimed by tbe plaintiff that at tbe time of ber marriage sbe bad • certain moneys in tbe custody of ber father wliieh were delivered to ber husband, the defendant, and that he bad invested tbe same in certain real property, which be agreed to convey to ber and represented that be had conveyed to ber.
