This was a bill filed in Macon Court of Equity by the plaintiff against the defendants, the widow and heirs at law of Darling Belk, dec’d. Answers were filed, replication entered, and the depositions taken, when, at Fall Term, 1840, of the said court, the cause was set for hearing and transmitted to the Supreme Court.

An action of ejectment was heretofore instituted by the defendants, the heirs of Darling Belk, deceased, to recover from the plaintiff a tract of land, which had been reserved unto the Indian Chief, Yonah, or the .Great Bear, in the treaty with the Cherokees of the 27th of February, 1819, and which was alleged to have been conveyed by the said Yonah, first to the said Belk, and after-wards to the plaintiff.
