DECISION AND ENTRY DENYING DEFENDANTS’ MOTION TO DISMISS OR, IN THE ALTERNATIVE, TO TRANSFER
RICE, District Judge.
Plaintiff is before this Court seeking redress for his allegedly unlawful separation from the United States Air Force. When Plaintiff resigned from the Air Force on April 4, 1961, “for the good of the service,” he was a Major with 15 years of activé duty and a Lieutenant Colonel in the inactive reserve with almost 20 years of service. Plaintiffs separation from the service became effective on May 2, 1961.
This is not Plaintiffs first attempt to pursue this cause of action.…
