The action here is trespass on the case, and on a trial before court and jury plaintiffs had a verdict and judgment against defendant for $2,000, from which defendant prosecutes this appeal.
The declaration consists of two counts, the first of which charges that defendant, between April 15th and 20th, 1911, took 900 tons of coal belonging to plaintiffs, with certain papers and books and disposed of and converted them to their own use.
