KRUEGER, Judge.
The appellant was tried and convicted of the offense of assault with intent to murder, and his punishment was assessed at confinement in the State penitentiary for a term of two years.
The indictment, omitting the formal parts thereof, reads as follows: “That Roger Dunn on or about the 1st day of June, A. D. 1934, and anterior to the presentment of this indictment, in the County of Kaufman and State of Texas, did then and there unlawfully in and upon B. B.
