On September 20, 1978, Charles Buffington was discovered dead in his home in Trenton, Georgia, having suffered severe blunt trauma to the head. Buffington was 80 years old when he died. The appellant was arrested and charged with the victim’s murder on October 21, 1978. A preliminary hearing was held on December 7, 1978, at which key witnesses for the prosecution were unwilling or unable to connect the appellant with the crime.
