This is an action of scire facias against bail. The defendant demurred to the declaration and the issue on the demurrer was argued before one of the justices in the Superior Court on the 3rd day of October, 1917. On the 15th of October, 1917, the court filed a rescript in the case sustaining the demurrer, and on the same day notice of the decision was duly sent by mail by the clerk of the Superior Court to the attorney of each party.
