This is an application by the petitioner, Eugene R. Kelley, Police Commissioner of Suffolk County, (1) for an order pursuant to section 701 of the County Law disqualifying the District Attorney and Assistant District Attorneys serving under him from taking further action upon a matter concerning the petitioner pending before the July, 1975 Holdover Grand Jury and appointing a Special District Attorney to continue the inquiry.
