The parties, except the defendant Rochester Savings Bank, are the children and grandchildren of Daniel Butts, and the determination of their relative rights and' interests in the lands sought to be partitioned depends upon the proper construction to be given to a deed of these lands made by Christian Butts to Daniel Butts, his son, on the 18th day of December, 1843. This deed, omitting the formal parts, was as follows:

“Party of the first part in consideration of the sum of thirty-five hundred dollars to him duly paid, has sold and by these presents does grant and convey the south half part of…
