delivering the opinion of the court, after making the foregoing statement:

The assignments of error are five in number. They all go to the propriety of the action of the court below in directing a verdict and rendering judgment thereon in favor of the deféndant below. In view of the disposition made of the case in the court below, we must assume that the injury was due to the negligence of-the son.
