On October 4, 1974, defendant, Jim Korelis, was indicted, together with his brother, George Korelis, on one count of theft in the first degree and on a sec ond count of attempted theft in the first degree. The indictment read in relevant part as follows:

“COUNT I
“The said defendants, on or about August 12, 1974, in the County of Multnomah, State of Oregon, did unlawfully and knowingly commit theft of one High Standard .22 caliber revolver, the property of Richard L.
