This is an action brought by the plaintiffs as the administrators of Mary Smith, to set aside an assignment by said Mary Smith to Jacob K. Lockman, of two bonds and mortgages, and the delivery of a check, amounting in all to about $10,000, and to compel Lockman to account for the amount of the said securities. The complaint alleges, among other things, that the Messrs. De Witt had charge of the bank books, securities and evidences of debt of the deceased, and that the "relation between them was that of clients and counsel, to a very unusually intimate and confidential degree."
