This was an action to recover a tract of land in Franklin county. The appellee was the plaintiff, and William Gordon, Peter Woods, and Amos Martindale, the defendants.

The complaint alleges these facts: Gordon, being the owner of the land in dispute, executed, acknowledged, and delivered to one William P. Montague, a bond and lease, which was, on the 11th of September, 1856, duly recorded the recorder’s office of said county. By the instrument thus executed, &c., Gordon leased the land to Montague for ten years, at the yearly rent of 25 dollars, binding himself, if Montague should pay 350…
