This is an action of tort to recover for personal injuries sustained in a fall on State Street, a public way, in the City of Springfield on July 13, 1962. The answer is a general denial; an allegation of contributory negligence; a denial that the locus of the accident was a public way and a demand that the plaintiff prove same. At a pre-trial conference, the parties stipulated that the locus of the accident was a public way under the control of the defendant.
