Appeal from Trial Term, Orange county. Action by Jacob Levy, as administrator of the goods, etc., of Antoni Prygon, against' the Grove Mills Paper Company. From an order dismissing the complaint and setting aside a verdict in favor of plaintiff, he appeals.

The defendant moved at the close of the plaintiff’s case for a dismissal of the complaint. The disposition of this motion was held until the close of the whole case, when the court, reserved its decision upon the motion, subject to the verdict of the jury. The defendant objected, and excepted to the submission to the jury. A general verdict for the plaintiff was reported, and after this report the defendant again moved to dismiss the complaint.
