The defendant in error, the New Omaha Thomson-Houston Electric Light Company, hereafter spoken of as the defendant, is a corporation organized for the purpose of generating and furnishing electric power and lights, and for some years has been engaged in that business in the city of Omaha. In the conduct of its business it has, by permission of the city of Omaha, erected poles in certain of the streets and alleys of the city, upon which wires are strung to convey the electric current from the place where generated to the place of use.
