The Town of Herndon is a small municipal corporation which lies wholly within Fairfax County. In a petition filed on February 12, 1952, against the County School Board of Fairfax County, it sought a declaratory judgment and consequential relief.
The court was asked to declare that petitioner had been constituted a separate school district, and as snch, was entitled to place one member on the County School Board of Fairfax County in addition to those appointed by the County Board of Supervisors; and to order defendant School Board to seat petitioner’s designated member.
