The plaintiffs in error were jointly indicted in the Court of Sessions for Onondaga county, upon an indictment containing three counts. In the first, it is charged that the prisoners, with others, riotously and unlawfully assembled on the first Tuesday of November, 1863, at an engine house in the 5th ward of the city of Syracuse, where an election had been held on that day, and then and there pulled down and destroyed the engine house in willful disobedience of the lawful commands of the inspectors of the election, and to the great terror, c.
