*203In this companion case to Behm v. City of Cedar Rapids , 922 N.W.2d 524 (Iowa 2019), and Leaf v. City of Cedar Rapids , 923 N.W.2d 184 (Iowa 2018), we consider challenges to an automated traffic enforcement (ATE) program implemented by the City of Des Moines (the City) and its private contractor, Gatso USA, Inc. (Gatso).

The plaintiffs challenged the Des Moines ATE program on a number of grounds. The plaintiffs claimed that the ATE program violated equal protection, due process, and privileges and immunities clauses of the Iowa Constitution. The plaintiffs further argued that…
