—Appeal by the People, (1) as limited by their brief, from so much of an order of the Supreme Court, Queens County (LaTorella, J.), dated October 5,1995, as granted that branch of the defendant’s omnibus motion which was to dismiss the first count of the indictment charging the defendant with burglary in the second degree, and (2) from a purported order of the same court, dated November 9, 1995, dismissing the same count of the indictment.
Ordered that the appeal from the purported order dated November 9, 1995, is dismissed, as no such order exists; and it is further,
