This is an action for damages for personal injuries.
One J. O. Kalleen ivas joined in the summons, but does not appear to have been served with process or further proceeded against.
The declaration having been Jiled, was demurred to; the demurrer was sustained and the suit dismissed, and the plaintiff has appealed to ' this Court and assigns as error the action of the Court in sustaining the demurrer. The declaration sets out the cause of action in substantially the following language:
