OPINION

Sommer, C.J.

This matter comes before the Court on the Claimants petition for compensation for unjust imprisonment, pursuant to section 8(c) of the Court of Claims Act, hereinafter referred to as “statute” (735 ILCS 505/8(c)), and the Claimants motion for summary judgment. A hearing was held on May 29, 1997, before Commissioner Rochford. Following the hearing a briefing schedule was established and the parties submitted briefs in support of their positions.
