CHRISTIAN, Judge.

The offense is selling intoxicating liquor, the punishment confinement in the penitentiary for two years.

The state’s witness, Esther Haddock, testified that he went to appellant’s house and bought a half gallon of whiskey from him. On cross-examination the witness stated that the transaction occurred at 8 o’clock on Saturday night. Everett Bennett, a witness for appellant, testified that he was with Haddock in the vicinity of appellant’s home on the occasion in question, which was about nine o’clock on Saturday night, April 2.
