Affirming.

On April 16, 1934, appellant by written proposal offered to purchase from appellee two lots which it owned in Louisville, with two buildings, admittedly in ■a run down condition. The writing evidenced that appellant would pay to appellee the sum of $900 for the lots; a cash payment of $100 within sixty days, and “assume” a mortgage for the unpaid balance. It was proposed that upon payment of the $100, a deed should be made to purchaser, with usual covenants. Appellant appended to his writing these words: ‘ ‘ The above proposition is good…
