Error to Jackson; Peck, J. Dwight Merriman appealed from an order probating the will of Howard L. Merriman, deceased. The will was again sustained in the circuit, and, a motion for new trial having heen denied, contestant removed the cause to this court by writ of error.

Appellant has brought here for review the proceedings had in the circuit court on appeal from the probate of the will of Howard L. Merriman, deceased. On a trial before a jury the will was adjudged a valid will. The objections to the probate of the will stated in the appeal from the probate court are that the deceased was possessed of an insane delusion in regard to the appellant, the father of the deceased, which delusion deprived the deceased of testamentary capacity; and that the alleged will was obtained by undue influence exercised upon the deceased.
