I. Introduction

This appeal stems from the Circuit Court of the First Circuit's ("circuit court") 1 grant of Quincy L.F. Choy Foo, III's ("Choy Foo") Motion to Dismiss Charges for Violation of Hawai'i Rules of Penal Procedure ("HRPP") Rule 48 (2000) ("motion to dismiss"). On April 5, 2013, the circuit court granted Choy Foo's motion to dismiss the charge with prejudice. 2
