Stephens was convicted of an assault and battery, and fined twenty-five dollars. He appealed to the Circuit Court, where the appeal was dismissed, because the condition of the bond was not in compliance with the statute. The court also refused a motion to amend the bond. Those decisions present the only questions in the case. The condition of the bond was as follows : “ If the said Simeon Stephens shall prosecute his appeal with effect, and shall pay whatever judgment may be rendered by the court upon dismissal or trial of said, appeal, then the above obligation to be void.” The statute…
