This case is before this Court upon the appeal of Robert L. McCabe from the April 20, 2005, order of the Circuit Court of Mo-nongalia County denying him relief in habeas corpus. McCabe was convicted in that Court, in 2000, of five felonies: three counts of obtaining money by false pretenses, one count of obtaining labor, services and materials by false pretenses and one count of conducting a fraudulent scheme.
