MEMORANDUM AND ORDER

SINGLETON, District Judge.

Petitioner was indicted in Harris County, Texas, upon a charge of robbery by assault. After a one-day trial, a jury found him guilty as charged. Upon a factual finding that the petitioner had before been convicted of a felony of like nature, his punishment was set pursuant to the Texas recidivist statute at life.1 The conviction was affirmed by the Texas Court of Criminal Appeals.
