Appeal from that part of an order of the Supreme Court (Reynolds Fitzgerald, J.), entered December 30, 2011 in Broome County, which, in a combined proceeding pursuant to CPLR article 78 and action for declaratory judgment, denied respondents’ motion to dismiss the second, third and fourth causes of action.
