The bill of exceptions in this case was presented to the trial judge on the 26th day of December, 1951, and was certified by him on the 29th day of February, 1952. No reason appears in the certificate of the judge, nor is any shown by the record for the delay in signing the bill of exceptions. A motion to dismiss was filed and a response thereto made setting up certain facts. An oral request was made by the attorney for the defendant in error at the time of the argument to withdraw the motion to dismiss.
